1. Acceptance of Terms
By accessing or using Pulse UpTime (“the Service”), you agree to be bound by these Terms of Use. If you do not agree to these terms, you may not use the Service.
2. Description of Service
Pulse UpTime provides monitoring tools designed to check the availability and performance of websites, servers, services, and scheduled jobs. The Service may include notifications, status pages, and related features.
3. No Guarantee of Availability or Accuracy
Pulse UpTime is provided as a best-effort monitoring service.
While reasonable efforts are made to ensure reliability and accuracy, the Service is not guaranteed to be uninterrupted, error-free, or fully accurate at all times.
Users acknowledge that:
- Monitoring checks may fail, be delayed, or produce incorrect results
- Notifications may not be delivered, may be delayed, or may fail entirely
- External factors (including network conditions, third-party services, or infrastructure issues) may impact performance
Pulse UpTime should not be relied upon as the sole method of detecting outages or failures.
4. Limitation of Liability
To the maximum extent permitted by law, Pulse UpTime and its operators shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from:
- Failure to detect an outage or issue
- Failure or delay in sending notifications
- Incorrect monitoring results
- Downtime of the Service itself
- Loss of data, revenue, business, or reputation
This includes, but is not limited to, damages resulting from reliance on the Service.
5. User Responsibility
Users are responsible for:
- Configuring monitors correctly
- Setting appropriate failure thresholds
- Maintaining alternative monitoring or alerting systems where necessary
- Ensuring contact information (email, phone, push tokens) is accurate
The Service is intended to supplement, not replace, comprehensive monitoring strategies.
6. Acceptable Use
Users agree not to misuse the Service, including but not limited to:
- Performing excessive or abusive monitoring requests
- Attempting to disrupt or interfere with the Service
- Using the Service for unlawful purposes
Pulse UpTime reserves the right to suspend or terminate accounts that violate these terms.
7. Third-Party Services
Pulse UpTime may rely on third-party providers (such as email, SMS, or infrastructure services). Pulse UpTime is not responsible for failures or delays caused by these third-party services.
8. Modifications to the Service
Pulse UpTime reserves the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.
9. Changes to Terms
These Terms of Use may be updated from time to time. Continued use of the Service after changes are made constitutes acceptance of the updated terms.
10. Termination
Pulse UpTime reserves the right to suspend or terminate access to the Service at its discretion, including for violations of these Terms.
11. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the applicable jurisdiction in which the Service is operated.

13. Abuse and Misuse of the Service
Users agree not to abuse or attempt to circumvent the limitations of their plan or the intended use of the Service.
Prohibited behavior includes, but is not limited to:
- Attempting to exceed monitor or usage limits through automation, duplication, or other means
- Using the Service in a way that creates excessive or unnecessary load
- Generating excessive failed notifications (including invalid or bouncing email or SMS destinations)
- Any activity that negatively impacts the stability or performance of the Service
Pulse UpTime reserves the right to suspend or terminate accounts that engage in abusive or suspicious behavior, with or without prior notice.
14. Billing, Payments, and Downgrades
All paid plans are billed on a recurring basis. By subscribing to a paid plan, you agree to maintain valid payment information.
If a payment fails:
- The account may be downgraded to the Free plan
- Features and limits associated with paid plans will no longer apply
When a downgrade occurs, monitors exceeding the Free plan limits may be automatically disabled. The selection of which monitors remain active is handled by the system and may not be user-selected.
Pulse UpTime is not responsible for any impact caused by monitors being disabled due to plan limits after a downgrade.
15. No Refund Policy
All payments are final.
Pulse UpTime does not offer guaranteed refunds for subscription fees. However, requests may be reviewed on a case-by-case basis at the sole discretion of the Service.
16. Service Automation and Responsibility
Pulse UpTime operates as an automated monitoring platform.
Users acknowledge that:
- System actions such as monitoring, alerting, disabling monitors, and plan enforcement are performed automatically
- Users are responsible for reviewing and managing their monitors and configurations
While Pulse UpTime will make reasonable efforts to maintain system reliability, users are responsible for ensuring their monitoring setup meets their needs.
In cases where a verified system malfunction occurs, Pulse UpTime will work to resolve the issue in a reasonable timeframe.
